Introduction
Arbitration is often less costly than court litigation because the process is quicker and generally less complicated in comparison. However, arbitration fees are increasing as more experienced lawyers take up the cause. This article will compare institutional arbitration fees and, respective ad hoc administration fees of some of the most preeminent contemporary arbitrary institutions worldwide.
The institutions mentioned are as follows: London Court of International Arbitration (LCIA); Singapore International Arbitration Centre (SIAC); International Chamber of Commerce (ICC); Hong Kong International Arbitration Centre (HKIAC); The Arbitration Institute of the Stockholm Chamber of Commerce (SCC);and The China International Economic and Trade Arbitration Commission (CIETAC).
The difference between institutional and ad hoc arbitration
An institutional arbitration is one in which a specialised institution intervenes and takes on the role of administering the arbitration process. Each institution has its own set of rules, which provide a framework for the arbitration, and its own form of administration to assist in the process.2This type of arbitration fee is more expensive compared to Ad hoc. An ad hoc arbitration is one, which is not administered by an institution. The parties will therefore have to determine all aspects of the arbitration themselves- for example, the number of arbitrators, appointing those arbitrators, the applicable law and the procedure for conducting the arbitration.
